With effect from 23rd January 2023 the Fire Safety (England) Regulations 2022, made it a legal requirement for ‘Responsible Persons’ of all multi-occupied residential buildings in England, with storeys over 11 metres in height to;

  • Undertake quarterly checks of all Fire Doors (including self-closing devices) in common parts of the building.
  • Undertake – on a best endeavour basis – annual checks of all flat entrance doors (including self-closing devices) that lead onto a building’s common parts.
  • To provide residents of all multi-occupied residential buildings (that have common parts) with essential information regarding the importance of Fire Doors to a building’s fire safety. This includes ensuring the flat entrance doors are properly maintained to function effectively in the event of a fire.

In the context of fire safety regulations in the UK, the term ‘Responsible Person’ typically refers to the individual or entity who has legal obligations and duties under the Regulatory Reform (Fire Safety) Order 2005.

The primary duty of the ‘Responsible Person’ under the legislation is to conduct a suitable and sufficient fire risk assessment for the premises they control.

Often the ‘Responsible Person’ is the employer, building owner, occupier, or any other person who has control over the premises or part of the premises.

The Responsible Person has the ultimate accountability for ensuring the buildings fire safety measures are maintained to the highest standard. Failure to meet these obligations can result in severe penalties and in some cases imprisonment.

A Fire Safety Enforcement Order is a legal directive issued by a fire authority or regulatory body to address serious fire safety deficiencies or violations within a building or premises. This order is typically issued when there is an imminent risk to life or property due to non-compliance with fire safety regulations.

There are different types of Notices:

Informal Notice: Suggests safety measures
Formal Fire Safety Notice: Specifies improvements needed and how to address them
Alterations Notice: Issued when premises have high safety risks due to changes in use
Enforcement Notice: Issued for serious unmanaged risks, specifying necessary improvements and deadlines
Prohibition Notice: Takes immediate effect if the risk is severe, restricting access to premises or parts of premises.

3CO conduct two different types of Fire Door inspections: intrusive and non-intrusive. These inspections serve different purposes and are tailored to meet the specific needs and requirements of our clients.

Non-Intrusive A Non-Intrusive Fire Door Inspection is a visual check without removal of any Fire Door set components. This level of check means we are only able to check the outside without dismantling the door set and potentially causing any damage, whilst still ensuring a comprehensive check to ensure the functionality and safety of the Fire Door.

Intrusive A Intrusive Fire Door inspection includes all visual checks inspected on a non-intrusive inspection however, intrusive inspections include the careful removal of architraves and ironmongery to check for intumescent protection and linear gap seals. Any damage would only be caused to architraves and aesthetics (any damages will be rectified immediately following the inspection).
